When a foreign national marries a United States citizen or a green card holder, he or she is eligible to obtain conditional status. After two years in a successful, viable marriage, the foreign national spouse may file a petition to remove the condition. However, many relationships do not last for two years following the marriage.

Protecting Your Status After Divorce

Should a foreign national marriage end prior to the two-year anniversary, a foreign national has the option to file a sole petition rather than a joint petition to remove his or her conditional status. If the marriage relationship deteriorated due to abuse, the foreign national may be eligible to file for immigration benefits under the Violence Against Women Act (VAWA).
